Possibility of Dual Agency Under current Massachusetts law, if a Buyer's Agent shows one of her agency's listings to a Buyer client (even if the listing broker is in an office in another town), a Dual Agency relationship arises. In my case, when Coldwell Banker Residential Brokerage represents both the Buyer and the Seller as clients, both parties are provided with a written disclosure of the circumstances in which a dual agency arrangement has arisen, and, should the Buyers proceed with an offer, its effect on their situation is expressly delineated.
